New York Premises Liability Laws: Learn About Actual Notice and Constructive Notice

Actual notice requires that a property owner be aware of a dangerous condition on their property. Constructive notice is when a property owner should have known about the hazardous condition even though they were unaware. 

Landlords play a big part in premises liability cases in New York. This includes inspecting properties for dangerous situations or conditions and taking steps to ensure people’s safety. Constructive notice

In New York, a person injured on someone’s property has a right to recover damages. This includes not just the owner of the property itself but anyone who has control over it. However, there are some situations where you might not be able to recover damages if you were injured on someone else’s property. One of these is called “constructive notice.”

Constructive notice means that even though you were unaware of the dangerous condition that caused your injury, the owner or occupier knew about it and failed to take reasonable steps to prevent it from happening. The law requires them to keep their premises safe for people who visit them.

For example, imagine someone was injured on your property because of a broken step in front of your building. You did not know there was a dangerous condition on your property, but you should have known because there were yellow markings on all other steps in front of the building. Therefore, constructive notice can be shown by showing that the plaintiff did not see any yellow markings on their way to getting injured and therefore did not realize there was anything wrong with this step.

In summary, it will be essential to know that if you are considering entering someone’s property, you must take reasonable steps to ensure it is reasonably safe. If you are invited onto someone’s property, make sure that the person inviting you is in a position to notify the property owner of any dangerous conditions.

However, one entrepreneur and perfume enthusiast, Anne-Krystel Goyer, hopes to make high-quality perfumes more accessible and affordable.

Together with a group of certified perfumers in Provence, Anne-Krystel developed her first Extrait de Parfum called AnneKrystel8. Extrait de Parfum essentially does not contain any additional water, like other types of fragrances, so it has better quality and is more long-lasting. According to her, each note in the olfactory pyramid of this perfume for women corresponds to a quality of the ideal woman.

Selling perfume is more than just a business to Anne-Krystel; it is also a form of activism. She wants to deepen people’s knowledge of perfumes to add value for her clients.

How Common Are Motorcycle Accidents (and Fatalities) in the USA?

Motorcyclists are at a higher risk of being injured in traffic accidents than drivers of other vehicles because motorcycles occupy a smaller and less visible area of the road, and riders are more exposed and, therefore, less protected. 

That means, sadly, many injuries and deaths involving motorcyclists happen every year. But exactly how common are motorcycle accidents and fatalities in the USA? Let us take a look at the stats to find out. 

Common Causes of Motorcycle Accidents in Big Cities
As you might expect, many motorcycle accidents happen in big cities because there is more traffic and more potential hazards. 

For instance, in Chicago alone, more than 100 people die in motorcycle collisions or crashes each year. And approximately 160 people die in New York every year due to motorcycle crashes.

Some of the most common causes of those accidents are:

  • Impairment due to alcohol or drugs. 
  • Negligence of motorcyclists and other vehicle drivers.
  • Distracted driving.
  • Hazardous weather conditions like snow, heavy rain, and high winds. 
  • Road hazards such as poor road conditions and debris on the road.

To explore those stats in more detail, we need to look at the National Safety Council’s analysis of the NHTSA’s Fatality Analysis Reporting System data

The findings show that while motorcycles account for only 3% of all registered vehicles in the US, motorcyclists were involved in a whopping 14% of all road fatalities and 4% of all injuries in 2020. 

The report also shows that fatalities among motorcyclists and passengers rose by 11% between 2019 and 2020, and over the last ten years, the number of deaths increased by 20%. 

Interestingly, the report also states that motorcyclists who were involved in fatal crashes during 2020 had higher percentages of alcohol impairment than operators of other vehicles. 

27% of motorcyclists involved in fatal crashes were impaired by alcohol in 2020, while 23% of passenger car drivers, 19% of light truck drivers, and 3% of truck drivers involved in fatal road accidents were impaired by alcohol. 

The Takeaway
While many motorcyclists ride regularly without ever being injured in accidents, as we have seen, many injuries and fatalities do occur every year. 

That is due to numerous factors, but it is largely due to the fact that motorcycles are less visible to drivers and are less stable than four-wheeled vehicles. 

Furthermore, operating a motorcycle requires the rider to use a different combination of mental and physical skills than drivers of cars and other four-wheeled vehicles. 

Motorcyclists and their passengers are also more vulnerable to weather conditions and road conditions than drivers in closed vehicles. Therefore, if you ride a motorcycle, you need to be extra vigilant to reduce your risk of being injured in a road accident. 

 

World Homeless Day: Social Entrepreneur Valerio Zanoli Gives Life to the Documentary “Homeless”

World Homeless Day is observed every year on October 10th to bring awareness to the issues of homelessness and inadequate housing. Homelessness is a global challenge: The United Nations Human Settlements Program estimates that 1.6 billion people live in inadequate housing, and the best available data suggest that more than 100 million people have no housing at all. Over half a million Americans sleep on the streets and in shelters every night. Inequalities are evident among subgroups, and risk is significantly tied to gender, race, and ethnicity. As with so many other areas of American life, historically marginalized groups are more likely to be disadvantaged within housing and homelessness spheres.

Valerio Zanoli is a film director and real estate investor (www.valeriozanoli.com) who has shaped his entire career around the concept of social entrepreneurship. He stated that “right after graduating from the University of Southern California School of Cinematic Arts, Mom passed away. The conference took place in a very critical moment in U.S. history: Rent prices are skyrocketing, inflation is the highest in decades, and a new recession is looming. In this context, the documentary “Homeless” provides an honest look at what it’s like to be homeless. Though it was filmed in Southern Nevada, it depicts a situation that affects every metropolitan area in the U.S. and is ever more urgent.

When in the past I was Assistant Coordinator at The Salvation Army Veteran Services, I was introduced to Valerio as a precious resource to help our homeless veterans get the affordable housing they deserve. Over the past few years, Valerio has helped an incredible number of veterans get back on their feet. He has always shown uncommon compassion and has never turned down a veteran in need. […] Having an ally like Valerio on our side is a precious resource and an inspiration. We share a deep desire to change the world around us and impact the future to end homelessness. The chronic lack of fair-priced accommodation in Las Vegas has become even worse with the Covid-19 pandemic. Over the years, Valerio Zanoli has developed numerous initiatives, including the project Helping Vegas (www.helping.vegas), which brings together several landlords, charities, and organizations that operate in Southern Nevada in a collective effort to mitigate the housing crisis. For the past several months, Zanoli has been supervising the renovation of 2 rooming houses, which Clark County Social Service will use to house up to 25 low-income individuals, every night, right in the heart of downtown Las Vegas. Christine Hess, Executive Director of Nevada Housing Coalition, fully supports this project and stated: “To end our affordable housing and homelessness crises, we must consider all opportunities to provide solutions that meet those in need where they are and support their path along the affordable housing spectrum to housing security. The renovation and expansion of these two rooming houses is one example of an alternative solution that can impact multiple lives for years to come in Las Vegas.”

HomelessThe several awards and certificates of appreciation that Valerio Zanoli received from the Governor of Nevada, U.S. Vets, The Salvation Army, and many other homeless and housing organizations are evidence not only of Zanoli’s achievements, but also of the fact that combining a successful business and social commitment is possible. If I am not serving you, I am not a leader.”

Valerio Zanoli added: “Unfortunately, fighting homelessness is still a daily commitment, and it is something that we cannot overlook or ignore. Charities like The Salvation Army and agencies like Clark County Social Service are doing an extraordinary job, but this is a social problem that affects all of us, and all of us – as a society – need to come together so we can solve it. … As a famous quote says: There is no ‘us’ and ‘them.’ There is only us, one human family, connected in ways we sometimes forget.”
