New York Premises Liability Laws: Learn About Actual Notice and Constructive Notice

Actual notice requires that a property owner be aware of a dangerous condition on their property. Constructive notice is when a property owner should have known about the hazardous condition even though they were unaware. 

Landlords play a big part in premises liability cases in New York. This includes inspecting properties for dangerous situations or conditions and taking steps to ensure people’s safety. If someone is injured due to an unsafe condition on another person’s property, they may be able to recover damages by filing a premises liability claim against that person. They must first show an unsafe situation to prove that actual notice existed.

Actual notice

In New York, actual notice can be obtained in two ways. First, if you were injured while on someone else’s property and there were multiple people present at the time of your injury, those witnesses may be able to testify whether you saw such a condition. Second, if no witness remembers your reaction when you saw the dangerous condition (for example, if you slipped and fell on ice), then the court may assume that you had actual notice because most people would have reacted in some way if they had seen such a condition.

A person who has actual notice does not need to prove that they were negligent for their case to proceed; however, if they were negligent and contributed to their injuries, they will probably only be entitled to damages up to $250k per person.

Constructive notice

In New York, a person injured on someone’s property has a right to recover damages. This includes not just the owner of the property itself but anyone who has control over it. However, there are some situations where you might not be able to recover damages if you were injured on someone else’s property. One of these is called “constructive notice.”

Constructive notice means that even though you were unaware of the dangerous condition that caused your injury, the owner or occupier knew about it and failed to take reasonable steps to prevent it from happening. The law requires them to keep their premises safe for people who visit them.

For example, imagine someone was injured on your property because of a broken step in front of your building. You did not know there was a dangerous condition on your property, but you should have known because there were yellow markings on all other steps in front of the building. Therefore, constructive notice can be shown by showing that the plaintiff did not see any yellow markings on their way to getting injured and therefore did not realize there was anything wrong with this step.

In summary, it will be essential to know that if you are considering entering someone’s property, you must take reasonable steps to ensure it is reasonably safe. If you are invited onto someone’s property, make sure that the person inviting you is in a position to notify the property owner of any dangerous conditions.

Raised in Europe, Kolja was enamored with the ins and outs of American culture. From the sporting industry to the hip-hop scene and eventually to fashion, there was a certain je nais se quois about these influences in America that he couldn’t seem to shake from his conscience. Fast forward several years, Kolja found himself in the grit of the finance industry, unfulfilled with its lack of creativity and the mundane lifestyle. He never forgot the influences from days past and the passion that lived inside of him yearning to be celebrated. For the next step in building his brand, Kolja traveled with fashion photographer Alessandro Amarante to New York City to shoot an editorial of his new collection with top models Damaris Barkley, Anastasia Kolganova and Allie Fosheim. Evolving from a collection of 6 t-shirts, the second collection makes a statement with entire outfits, including hoodies, pants, t-shirts as well as jackets and custom hardware.

Season 2 and its corresponding imagery represent a vision that has come full circle, which is expected to be dropped this winter at koljaannussek.com.

The right perfume has the power to make an impression and express a person’s personality. But, unfortunately, quality perfumes can be tough to find and are often outside people’s budget range. However, one entrepreneur and perfume enthusiast, Anne-Krystel Goyer, hopes to make high-quality perfumes more accessible and affordable.

Together with a group of certified perfumers in Provence, Anne-Krystel developed her first Extrait de Parfum called AnneKrystel8. Extrait de Parfum essentially does not contain any additional water, like other types of fragrances, so it has better quality and is more long-lasting. According to her, each note in the olfactory pyramid of this perfume for women corresponds to a quality of the ideal woman.

Selling perfume is more than just a business to Anne-Krystel; it is also a form of activism. She wants to deepen people’s knowledge of perfumes to add value for her clients. 

Furthermore, she wants perfume users and potential clients to be aware that there are four different types of perfumes: Extrait de Parfum, also known as “perfume,” Eau de Parfum, Eau de Toilette, and Eau de Cologne. Because most people mistakenly believe they are wearing perfume when they are wearing Eau de Parfum and not actual perfume, she calls her creations “Extrait de Parfum” to make it simpler, more distinct, and, most importantly, to avoid confusion.

Anne-Krystel developed the AK47 as a male Extrait de Parfum. After that, she also started selling cosmetics like moisturizers, oils, masks, and serums. As Anne-Krystel expands her network and widens her reach, she wants to offer her products to those who enjoy fragrance and cosmetics. Anne-Krystel stated in an interview, “I want people to understand the differences in perfumery and I want prospective customers to comprehend why I offer high-quality products at the lowest possible cost.”

One of the most distinctive aspects of her brand is the price. While major fashion houses charge approximately $150 for 7 milliliters and $700 for 50 milliliters of Extrait de Parfum, she sells a travel-sized bottle of her perfume for only 19 dollars.

Anne-Krystel studied fashion for a few years, later leading her to the desire to make perfume. With all the dedication she has poured into every bottle of her fragrances, she hopes those who use them experience calm and self-assurance. She knows how intensely scents can positively affect one’s self-esteem, which is why she works hard to create scents that make women and men feel confident.
